Primal training - Terms and Conditions 

Introduction

These Terms and Conditions govern all products, memberships, coaching services, classes, programmes, digital content, bookings and facilities operated under the Primal Training banner, including Primafit UK, F2LOnline, Noble Christopherson and Prima Junior. References to “Primal Training”, “we”, “us” or “our” mean the collective trading group. By purchasing from us, booking with us, entering our premises, accessing our website, or using any of our services, you agree to be legally bound by these Terms.

Definitions

  • "You" (the consumer): Refers to any individual who purchases a membership or uses the products, services, or fitness facilities of Primal training. It also includes those who engage with the self-employed personal trainers (PTs) operating within Primal training’s establishments.
  • “we”, “us” or “our” Refers to collective trading group Primal Training.
  • Facility means any gym, studio, training venue, online platform, or event operated by us.
  • Coach / Trainer means employed or self-employed professionals delivering services through our brands.
  • Minor means anyone under the age of 18




General Terms

  • Acceptance of Terms: By purchasing any product, service, or membership, using the Primal training website, or entering any Primal training facility you agree to be legally bound by the terms and conditions set out here. Failure to adhere to these terms may result in legal action.
  • Amendments to Terms: Primal training reserves the right to amend these terms at any time without prior notice. The latest version of the terms will always be available on the Primal training website. Continued use of Primal training services or facilities implies acceptance of the current terms. Primal training will only amend the terms and conditions to comply with new or updated legislation or government regulations or to meet any changes in the business which requires the terms and conditions to be amended.
  • Modifications to Products and Services: Primal training reserves the right to modify or remove any products, services, or content on the website at any time without prior notice.
  • Intellectual Property: All trademarks, logos, and content on the Primal training website are owned by Primal training. No part of this content may be copied, reproduced, or used without prior written consent from Primal training. Copyright of all the content of Primal Trainings website and products is owned by Primal Training therefore any persons or users are prohibited from copying, removing, altering or imitating any content owned by Primal Training for any reason including to sell, resell or make commercial use of any products or content owned by Prima Premium LTD.
  • Third-Party Links: Primal training is not responsible for third-party websites or content that may be linked or associated with its website. Any such links will be removed as soon as identified.

Consumer Conduct and Responsibilities

  • Age Requirement: You must be 18 or over to use Primal training’s products, services, and fitness establishments. If under 18, your use of the services must be supervised by a parent or guardian who accepts full responsibility for your safety, conduct, wellbeing and use of the website. It is the parent/ guardian’s responsibility to make sure the minor is taking part in the class safely and behaving in an appropriate manner. When arriving and leaving the fitness establishment Primal training hold no responsibility for the safety of the minor.
  • Parent & Guardian Responsibility: All participants under the age of 18 must be accompanied and supervised by a parent, legal guardian or responsible adult approved by the parent or guardian during all Primal Training activities unless expressly agreed otherwise in writing. Parents and guardians remain responsible for: supervising behaviour, Ensuring instructions are followed, Providing relevant medical information, Ensuring minors participate safely within their capability. We reserve the right to refuse participation or remove any participant where behaviour, safety or welfare concerns arise.Any accident, injury, welfare or safeguarding concern should be reported to a member of the Primal Training team immediately.
  • Code of Conduct: All users must behave appropriately, refrain from illegal activity, and avoid damage to equipment or property. Primal training reserves the right to revoke membership for breaching these terms.
  • Use of Content: All users are prohibited from downloading, modifying, or illegally using any content from Primal training’s website. Security breaches or uploading harmful files are strictly forbidden.
  • Non-Members: Non-members are prohibited from using Primal training facilities. Bringing unauthorised individuals into unmanned gyms will result in penalties, including a administration charge and potential membership termination.
  • Consumer Indemnification: By you (the consumer) purchasing products/services/memberships of Primal Training (and/or) use of the Primal Training website (and/or) use of any Primal Training facility you therefore adhere to the terms and conditions of Primal training therefore agree that Primal training will not be liable for any loss or damages through the use of Primal Training’s products/services/fitness establishments or website use

Accessibility

Primal Training is committed to creating an inclusive environment for all members.

We aim to make our facilities, services and online content accessible wherever reasonably possible.

If you require adjustments, support or accessibility information before attending, please contact our team and we will do our best to assist.

Health, Safety, and Liability

Whilst every effort is made by Primal Training to keep fitness activities safe and enjoyable you (the consumer) are participating in these activities of your own free will and as with any exercise there is a risk of injury which Primal Training will not be responsible for. You (the consumer) acknowledge and understand that you are responsible for your own health, well-being and safety when using any products/services provided by Primal Training.

  • Health Declarations: By using Primal training’s products or facilities, you confirm that you are in good health and not knowingly incapable of exercising. You agree to assume all risks associated with physical exercise, acknowledging that Primal training is not responsible for injury, health issues, or death resulting from use of its services.
  • Use of Equipment: You must ensure the safe use of gym equipment. If unsure about any exercise or machine, you must seek guidance from a staff member. Primal training is not liable for any safety issues that may arise from improper equipment use.
  • Property Damage or Loss: Primal training is not responsible for the loss, theft, or damage of personal property while using its facilities.


Membership and Payments

  • Memberships: Memberships are personal, non-transferable and may not be shared. By joining, you agree to provide accurate personal and payment details, maintain confidentiality of access credentials, comply with facility rules, pay all fees when due, and notify us of relevant health matters. We reserve the right to suspend access where payments fail or these Terms are breached.
  • Payments: All payments for services, memberships, or products must be made directly to Primal training. Once payment is received, your order will be processed. All charges are payable in advance or on the agreed recurring billing date. Memberships that renew automatically shall continue until validly cancelled in accordance with these Terms. In the event of failed payment, we may retry collection, suspend services, apply reasonable administration charges, and recover outstanding sums. By providing Direct Debit or recurring payment details, you authorise Primal Training and its payment providers to collect membership fees and any applicable agreed charges in accordance with your membership agreement. It is your responsibility to ensure payment details remain valid and up to date.
  • Additional payments: Any services, products or benefits not included within your current membership package shall be charged separately at the prevailing rate, including without limitation personal training, specialist classes, programmes, events or premium access services. We reserve the right to amend pricing upon reasonable notice.
  • Cancellation: All subscriptions or memberships require 30 days' notice prior to the payment due date to cancel. Failure to provide this notice will result in the payment being processed, and no refund will be issued.
  • Membership Changes: Any request to change membership type, including upgrades or downgrades, requires not less than 30 days’ notice prior to the next billing date unless otherwise agreed. Upgrades may take effect immediately at our discretion.
  • Refunds:.All deposits, discount, memberships and subscription payments made to Primal Training are NON REFUNDABLE.  All Primal courses (Transformation, Perimenopause and Hyrox) are to be Paid in full if one or more sessions have been attended. Limitation of Liability
  • Exceptional circumstances: While memberships are structured as flexible rolling agreements with a cancellation notice period rather than fixed-term contracts, we understand exceptional situations can arise. Temporary pauses or account adjustments may occasionally be considered at management discretion. Any such arrangements are entirely discretionary and do not form part of the standard membership agreement.



Facility

When using our facilities, you must conduct yourself respectfully toward staff and other users, wear appropriate clothing and footwear, use equipment safely, return equipment after use, comply with displayed notices and staff instructions, and refrain from abusive, threatening or dangerous behaviour. We reserve the right to refuse entry or remove any person in breach of these obligations.

  • Access Control and Unauthorised Entry: Access credentials must not be shared. You must not permit entry to non-members or misuse any security or access systems. Unauthorised access may result in immediate suspension, termination and the recovery of reasonable associated costs.
  • Open Gym Use: Users are advised not to train alone when the gym is unmanned due to health and safety risks. Primal training excludes all liability for incidents occurring in unmanned facilities.
  • Facility closure: In the unlikely event that any facility of Primal training is instructed to close for any reason which is beyond the control of Primal training for up to a maximum period of 8 weeks, Primal Training will deliver an online membership programme to enable you (the consumer) continued use of Primal Training’s products/services and fitness programmes via an online portal to be covered by the recurring monthly membership fee. This excludes any closures relating to any structural issues with the buildings (and/or) any staffing issues within Primal Training

CCTV & Security

CCTV may operate within and around our facilities for:

  • Member safety
  • Crime prevention
  • Incident investigation
  • Security monitoring

CCTV footage is processed in accordance with applicable data protection laws and retained only for as long as reasonably necessary.

By entering our facilities, you acknowledge that CCTV recording may take place.


Coaching and Trainers

Services may be delivered by employed personnel or self-employed coaches operating in conjunction with Primal Training. Where services are provided directly by a self-employed coach, that individual remains responsible for their own qualifications, insurance and professional conduct unless expressly stated otherwise. Individual results will vary and no specific outcome is guaranteed.

Online Coaching & Digital services

Online coaching, programmes and educational materials are provided for general fitness and wellbeing purposes only.

Information provided through our apps, videos, coaching systems, PDFs, messaging platforms or online communities does not constitute medical, nutritional, physiotherapy or mental health advice.

Results vary between individuals and depend on factors including consistency, lifestyle, training history, nutrition, sleep and adherence.

Members are responsible for exercising within their own capabilities and seeking professional medical advice where appropriate.

All digital content remains the intellectual property of Primal Training and must not be copied, shared, distributed or resold.


Termination and Indemnification

  • Termination of Use: Primal training reserves the right to terminate any membership or deny access to its facilities or services without prior notice. If you breach these terms, no refund will be provided, and legal action may be pursued.
  • Indemnification: By using Primal training’s products or services, you agree to indemnify Primal training from any claims, legal actions, or damages that arise due to your use of its products, services, or facilities.


Orders and Purchases

  • Fraudulent Use: If Primal training suspects that you have allowed a third party to illegally use your membership or access the website, Primal training reserves the right to cancel your contract without refund.
  • Incorrect Information: If you provide false or misleading information during the purchase process, Primal training may cancel your order and terminate your access to its services without prior notice.

We aim to resolve concerns fairly and quickly. If you have a complaint or dispute please contact a member of staff. If the complaint or dispute isn’t resolved. We aim to investigate and respond within a reasonable timeframe.

Final Provisions

  1. Governing Law: These terms are governed by UK law, and any legal disputes will be settled within the jurisdiction of the UK courts.
  2. Entire Agreement: These terms constitute the entire agreement between Primal training and you. By continuing to use Primal training’s products, services, or facilities, you agree to the terms as laid out here.
